Worldwide: How to Resolve Business Contract Disputes in India?

Foreign organisations investing in or trading with Indian parties are often anxious about the perceived risks and potential problems associated with enforcing business contracts in India and the resolution of business contract disputes.

This webinar will explore the options for foreign organizations in managing and resolving business contract disputes with Indian parties including contract drafting, mediation, conciliation, expert determination, litigation in the Indian courts, litigation in foreign courts, domestic arbitration, and international arbitration.

The aim of the webinar is to apprise foreign organizations of some of the key issues to be considered in selecting appropriate dispute resolution mechanisms to:

  • inform important decisions about the available options and their merits and deficiencies at the time of contracting; and
  • provide practical insight into the reasons for the exponential growth of arbitration in cross border disputes involving India as the clearly preferred method of dispute resolution. 
SPEAKERS
Matthew Gearing

Matthew Gearing QC is an exceptionally highly regarded litigation lawyer, with particular expertise in international arbitration, where he enjoys global recognition.

He has particular experience of acting in arbitrations across Asia, having been principally based in Hong Kong for many years prior to returning to the UK in 2020.

Within Chambers Global 2022, he is ranked as a Global Market Leader for Arbitration (International), in the Spotlight Table for arbitration in the Asia Pacific region and in band 1 for his arbitration work in Singapore. His arbitration expertise in China, India and Philippines is also recognised in the guide.

Kingshuk Banerjee

Kingshuk Banerjee is a Partner in the Dispute Resolution practice group in the Mumbai office.  Kingshuk specialises in a variety of commercial and contractual disputes. He has represented clients in disputes arising out of M&A transactions, international/ domestic joint ventures, investor-promoter agreements, expert determinations, maritime disputes, construction contracts, recovery of debts, intellectual property rights, insurance claims and real estate development and transactions.

Kartikey Mahajan

Kartikey Mahajan is a Partner in the Dispute Resolution practice group in the Singapore office. Kartikey is qualified to practice law in India, England & Wales (where he has rights of audience for all courts) and the State of New York. 

His practice focuses on international arbitration (both commercial and investment treaty) and commercial litigation with a cross-border element. He appears as an advocate in his arbitrations and has also sat as an arbitrator in a variety of matters. Kartikey has experience in representing clients in institutional (including under ICSID, SIAC, ICC, LCIA, HKIAC, AAA and GAFTA Rules) and ad-hoc seated arbitrations in both common law and civil jurisdictions around the world.

Raj Panchmatia

Raj Panchmatia is a Partner in the Dispute Resolution practice group in the Mumbai office. He specialises in advising clients on dispute resolution and commercial litigation. He handles matters both in domestic and international fora and has advised clients on a wide variety of claims under the Indian arbitration laws, SIAC, LCIA, ICC, UNCITRAL and HKIAC, and has extensive experience in dealing with disputes under all forms of contracts and agreements.

Raj is appointed on the SIAC Panel of Arbitrators and HKIAC List of Arbitrators. He is also on the Panel of Singapore International Mediation Centre (SIMC) as an India Specialist Mediator and a Singapore International Mediation Institute (SIMI) Accredited Mediator.

Jayne Kuriakose

At DXC (and legacy HPE), Jayne previously focused on large outsourcing Deals. She currently leads the regional practice for complex pre-litigation disputes and litigation across ASIA. She provides strategic advice to the APAC Management on complex disputes, investigations and litigation.
