As members of the sector know, the Not-for-Profit Corporations Act (Ontario) (the "ONCA") was passed in 2010 but is not yet in force.  The Ontario government recently made some changes to the ONCA and other legislation in the Cutting Unnecessary Red Tape Act, 2017, which became law on November 14, 2017.

As reported on its website, the government has advised that:

"We are:

  • upgrading our technology to support these changes and improve service delivery
  • working to bring ONCA into force as early as possible, with a target of early 2020. This gives not-for-profit corporations at least 24 months' notice before ONCA comes into force."

The government has said for some time that it would give at least 24 months' notice of the ONCA coming into force. It appears this recent announcement may signal the start of the notice period.
