Worldwide: Cross Border Fraud: Dubai to BVI via London

In this roundtable discussion, HFW's panel of litigation experts focus on the increase of cross border fraud in Dubai, the BVI and London, the far reaching impact of cross border fraud, as well as the role each region plays. 
 
Taking aspects from real world case studies, the team considers the systemic nature of this type of fraud, how it is so easily conducted and the repercussion in relation to litigation proceedings.

SPEAKERS
Rick Brown

Rick is Co-Head of the Fraud and Insolvency team. Rick specialises in complex, high value cross-border fraud and insolvency matters, including those which involve claims for breach of contract, fraud and/or breach of fiduciary duties and asset tracing. He has also worked on a number of offshore trust matters in the Caribbean, Gibraltar and elsewhere. He regularly deals with and instructs investigators and offshore lawyers. Rick has considerable experience in acting for insolvency practitioners, mainly on contentious complex cross-border insolvency matters. He has valuable experience of interlocutory hearings and trials in the Commercial Court in the British Virgin Islands and elsewhere in the Caribbean and has significant experience acting for clients on claims involving parties from Russia and the CIS, as well as the Middle East.

Simon Jerrum

Simon is a partner in the fraud and insolvency team at HFW. Simon specialises in commercial and insolvency litigation, often involving allegations of fraud or wrongdoing. Simon has particular expertise in complex contentious insolvency matters, often involving concurrent proceedings in a number of jurisdictions and the recovery of assets based overseas. He advises insolvency practitioners, directors, companies, investors and high net worth individuals on complex cross-border insolvency matters, often involving concurrent proceedings in more than one jurisdiction. He has substantial experience of disputes before the English courts, in addition to litigation and arbitration in key venues around the world.

Scott Cruickshank

Scott is the Office Head and Head of Litigation of the BVI office. He has worked at the forefront of complex, high-value BVI litigation for almost 15 years. He has considerable experience in shareholder disputes, insolvency, fraud and asset tracing, trust litigation, and corporate and commercial disputes generally. Prior to 2008, Scott was a practising Barrister at the Scottish Bar where he built up a sizeable and successful practice as a corporate and commercial litigator. In February 2008, Scott relocated to the BVI. In September 2009, he was appointed Partner and Head of Litigation of the BVI office of Lennox Paton. He remained in this position for in excess of 12 years prior to joining HFW.

Nicholas Braganza

Nick is a dispute resolution partner in HFW's Dubai office, and has worked in the UAE since 2012. He has a broad commercial disputes practice with a focus on fraud and insolvency, as well as shareholder and joint venture disputes. He has significant experience litigating in the DIFC, ADGM and UAE onshore Courts, as well as major arbitral venues in the UAE and internationally. In addition, Nick has experience in advising on white collar crime matters and conducting internal and regulatory investigations in the Middle East. Nick has advised clients and conducted investigations on a range of topics including cases of theft and fraud, bribery and corruption, defrauding government authorities, antitrust infringements, sanctions breaches, and money laundering.

Tanisha Saxena

Tanisha is an Associate in the Commodities team and specialises in international fraud and insolvency dispute resolution, advising on major fraud and insolvency disputes, usually complex, cross-border and high-value. Her experience includes actions brought under the auspices of the DIFC Courts, the ADGM Courts and the local onshore Courts.

Tanisha also has a wide range of experience in ADR, including mediation and arbitration. Tanisha is admitted as a Solicitor in England and Wales, and has experience practicing both in the UAE and the UK.
