Bribery laws and enforcement are becoming tougher.

Not least is the recent implementation of the UK's Bribery Act in July 2011, which requires companies to have in place "adequate procedures" to prevent bribery.

Education, training and testing are important components of those procedures.

Many products on the market simply test knowledge or test an ability to pass an assessment. We have identified, however, that such testing programmes are not as effective as they should be.

For this reason, we have been developing a product aimed at testing the understanding and confidence of employees in relation to bribery laws.

This involves, in particular, evaluating whether employees truly understand matters such as:

  • what qualifies as a bribe;
  • what to do if confronted with a request for a bribe;
  • controls and processes in place to prevent bribery;
  • how to identify a red flag;
  • the consequences for individuals and the company of bribery; and
  • how such matters come to light.

In addition to testing understanding, the product will also test confidence.

The most dangerous people in an organisation are those who lack proper understanding, but believe nonetheless that they are right.

Our process identifies such people and forecasts the human risk of breaching the law through ignorance or misunderstanding.
