The law relating to capacity in various offshore jurisdictions is examined and the extent that settlors can take advantage of recent offshore legislation to prevent challenges to trusts on the grounds of lack of capacity of the settlor.

The capacity ie the legal ability of a person to do something. The question of the capacity of the settlor is therefore of fundamental importance.
