On 12 March 2024, Law No. 6698 on Personal Data Protection ("PDPL") was amended with reference to the transfer of personal data abroad. On 9 May 2024, the Draft Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad ("Draft Regulation") was opened for public comment by the Personal Data Protection Authority ("Authority").

On 17 May 2024, in line with the Draft Regulation, the Authority published a Public Announcement on Draft Documents regarding Standard Contracts and Binding Corporate Rules ("Announcement"). Accordingly, comments on the draft documents may be submitted to the Authority until 27 May 2024. Comments have been invited specifically on the following:

  • Standard Contract – to be used for the transfer from one data controller to another data controller.
  • Standard Contract – to be used in the transfer from the data controller to the data processor.
  • Standard Contract – to be used for the transfer from one data processor to another data processor.
  • Standard Contract - to be used in the transfer from the data processor to the data controller.
  • Application form for binding corporate rules for data controllers.
  • Key considerations for binding corporate rules for data controllers ( guidelines).
  • Application form for binding corporate rules for data processors.
