Besprechung von LAG Hessen Urt. v. 25.6.2021 – 14 Sa 1225/20, NZA-RR 2021, 598

Eine aufsehenerregende Entscheidung des LAG Hessen aus dem Sommer 2021 erhöht die Risiken für Arbeitgeber bei gesetzlich erforderlichen Massenentlassungsanzeigen erheblich. Der Arbeitgeber muss demnach zwingend auch solche Angaben machen, die nach dem Wortlaut des Kündigungsschutzgesetzes und nach der bisher einhelligen Auffassung der Arbeitsverwaltung nur freiwillig sind. Fehlen diese Angaben in der Anzeige kann dies zur Unwirksamkeit aller Kündigungen im Rahmen der Massenentlassung führen. Die Praxis wird sich bis auf Weiteres auf diese neue Stolperfalle einstellen müssen. Der Beitrag gibt Argumentationshilfen für die kündigungsschutzrechtliche Praxis.
