自 2020 年 11 月 30 日起,任何适用于登记某些土地权益(转让或某些租赁)的土地所有者或租户还必须向土地所有者透明度登记处(Land Owner Transparency Registry,“LOTR”)提交透明度声明。作为“土地所有者透明度法”(Land Owner Transparency Act,“LOTA”)定义的“报告主体”的每个受让人还必须在转让或租赁的同时向LOTR提交透明度报告。

此外,持有在2020年11月30日之前收购的土地权益的现有“报告主体”必须在 2021年11月30日之前向LOTR提交透明度报告。报告主体包括大多数公司、有限合伙企业和信托。预计省政府将在未来几周内向企业报告主体发送一封信。

根据LOTA,未能提交透明度报告被视为违法行为,并可能引发巨额罚款,即以下两种较高金额:(i) 个人25,000加元或公司或其他实体50,000加元;(ii) 物业评估价值的15%。

截至2021年9 月 27 日,数千个报告主体中只有 2,753 个向LOTR提交了透明度声明或透明度报告。因此,如果您目前还没有提交LOTA文件,那么您还没什么问题。虽然在接下来的 2 个月内提交的登记可能会显著增加,但大多数受影响的土地所有者似乎不太可能在 2021 年 11 月 30 日之前提交其LOTA报告。省政府可能会推迟强制措施,直到更大范围的土地所有者承担报告义务,但您不能寄希望于此。
