Guernsey's Committee for Home Affairs has published the new Data Protection Law which will replace the Bailiwick's existing data protection legislation. It will then be considered by the States of Alderney and Sark Chief Pleas in December 2017, before approval can be granted by the UK Privy Council.

The publication of the new law implements Europe's requirements under the General Data Protection Regulation ("GDPR") and the Directive relating to the Processing of Personal Data for the Purposes of the Prevention of Crime (Law Enforcement Directive) and follows two years of collaboration between the States of Guernsey and various industry working groups.

This demonstrates the Bailiwick's commitment to uphold international data protection standards and has been drafted with the intention of ensuring Guernsey's adequacy status going forwards.

The new law will impact all businesses in Guernsey when it is intended to come into force on or around 25 May 2018 (the date on which the GDPR itself will be enforced).
