Turkey Ratifies the Council of Europe Convention 108 Concerning the Automatic Processing of Personal Data & “Additional Protocol to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data regarding Supervisory Authorities and Trans-border Data Flows”
The Law on Ratifying the “Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data” (Convention 108) has been published in the Official Gazette on February 18, 2016. The Convention was signed by Turkey on January 28, 1981 in Strasbourg and its ratification was completed just before the enactment of the Law on Protection of Personal Data which was published in the official gazette dated May 24, 2016.
Following the ratification of the Convention, the “Additional Protocol to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data regarding Supervisory Authorities and Trans-border Data Flows” dated November 08, 2001 has been published on the Official Gazette on May 24, 2016 in Turkey.
The Convention and the Additional Protocol are duly accepted International agreements which have been duly put into force and have the force of law. Thus, it is to be noted that in the case of a conflict between international agreements, duly put into force, concerning fundamental rights and freedoms and the laws due to differences in provisions on the same matter, the provisions of international agreements shall prevail.
